SHAI Terms of Service

These Terms of Service govern use of the SHAI online store and purchases made through it. By using the site or placing an order, you agree to these terms and to the policies posted on the store, including our Privacy, Shipping and Returns information.
Legal operator
SHAI is a brand operated by BKS TRADING INC., an Ontario corporation. Registered office: 290 Caldari Road, Suite M111, Concord, Ontario, L4K4J4, Canada. Customer support can be reached at shai.official.apparels@gmail.com.
Eligibility
By placing an order, you represent that you have legal capacity to enter into the transaction in your jurisdiction, or that you are acting with the authorization of a parent or legal guardian where required.
Products and imagery
We aim to describe products accurately. Colours and appearance can vary depending on screens, lighting and normal production tolerances. SHAI may use campaign, concept or editorial imagery for brand storytelling. Where concept imagery is used, it will not intentionally be represented as a substitute for the actual manufactured product. Product pages will be updated with real-garment photography, measurements and verified specifications as those materials become available.
Orders and availability
Submitting an order is an offer to purchase. SHAI may accept or decline an order where inventory is unavailable, payment cannot be verified, pricing contains an obvious error, fraud is suspected, or fulfillment is not possible. If payment has been collected for an order that cannot be fulfilled, the applicable amount will be refunded.
Pricing, currency, taxes and payment
The price, transaction currency, applicable taxes, shipping charges and final order total will be displayed during checkout. Canadian taxes will be handled according to applicable law and the registrations and settings in effect for BKS TRADING INC. at the time of purchase.
Shipping, returns and refunds
Shipping, returns and refunds are governed by the policies posted on the site at the time of purchase. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under applicable Canadian consumer-protection law.
Intellectual property
The SHAI name, logos, graphics, artwork, photographs, text, product concepts, MOVE YOUR WAY identity and other original brand materials are owned by or licensed to BKS TRADING INC. and may not be copied, reproduced, distributed or commercially used without permission except as permitted by law.
Prohibited use
You may not use the site for unlawful, fraudulent, abusive or security-compromising activity; interfere with operation of the store; attempt unauthorized access; or use SHAI intellectual property without authorization.
Third-party services
The store is powered by Shopify and may use payment providers, carriers, fulfillment providers, analytics services and other third-party services. Those services may be subject to their own terms and privacy practices.
Liability
To the fullest extent permitted by law, BKS TRADING INC. will not be liable for indirect, incidental, special or consequential losses arising from use of the site or products where such liability may lawfully be limited. Nothing in these terms limits liability that cannot be limited or excluded by law.
Governing law
These terms are governed by applicable laws of Canada and Ontario, without limiting mandatory consumer rights that apply to you in your jurisdiction.
Changes
We may update these terms from time to time. The version posted when an order is placed will govern that purchase, subject to applicable law.
